Pismo podrške sindikatima Australije i upravi Cochlear

Drage kolegice i kolege, dragi prijatelji,
Neugodno nas je iznenadila vijest, koju smo saznali od naše zajedničke sindikalne svjetske organizacije radnika u metalnoj i elektroindustriji IMF o problemima koje kao sindikat imate u području zaštite radničkih prava. Bili smo uvjereni da u vašoj zemlji takvi problemi ipak ne postoje ili su izraženi u manjoj mjeri. Sindikat metalaca Hrvatske koji organizira 23 000 članova u metalnoj i elektroindustriji ima uvijek manje ili više problema s poslodavcima koji bez skrupulozno krše sindikalna i ljudska prava pa u potpunosti razumije vaše probleme i nastojanja da vaše članove zaštitite od takvog menađmenta kakav vodi Cochlear. Sindikat metalaca Hrvatske daje vam bez rezervnu podršku u vašim nastojanjima da zaštitite članstvo, ali da pri tome uspijete i u približavanju radnog zakonodavstva onom koje se barem do sada primjenjuje na radnike u Europi. Tu posebno mislimo na primjenu Konvencija Međunarodne organizacije rada br. 87. o slobodama udruživanja i zaštiti prava na organiziranje i br. 98. o slobodi udruživanja i zaštiti prava na organiziranje kao i na radno zakonodavstvo kojim je to omogućeno i prema kojem radnici ostvaruju participaciju u odlučivanju i upravljanju tvrtkom. Vašim uspjesima se unaprijed veselimo i u njih vjerujemo. Oni će imati odraza i na zaštitu naših članova, jer globalizacija nema granica kao ni borba za zaštitu prava radnika.

Dear colleagues, dear friends,

We have been unpleasantly surprised with the news and information we received from our joint international trade union organization of workers in metal and electro industry IMF about the problems that you as a trade union are facing with regard to protection of workers’ rights.
We were convinced that in your country these problems did not exist or that they were less pronounced.
The Metalworkers’ Trade Union of Croatia who organizes 23 000 members in the metal and electro industry always has more or less problems with the employers who unscrupulously violate trade union and human rights, so we completely understand your problems and efforts to protect your members from the management in Cochlear.
Metalworkers’ Trade Union of Croatia gives its unstinting support to your efforts to protect your membership, and also in doing so to manage to bring closer your labour legislation to the one that is at least so far being applied to workers in Europe. In this respect especially important is the application of the ILO Convention No. 87 on the Freedom of Association and Protection of the Right to Organize and ILO Convention No. 98 on the Freedom of Association and the Right to Organize and Bargain Collectively, as well as the labour legislation which allows for these actions and in line with which workers are entitled to participate in decision-making and in management of the company.
We are looking forward to your successes, and we believe in them. They will have impact on the protection of our members too, because globalization has no borders, nor does our fight for the protection of workers’ rights.

Poštovani gospodine Roberts!
Informacija o kršenju ljudskih i sindikalnih prava stigla je i do Sindikata metalaca Hrvatske koji u Hrvatskoj ima učlanjeno gotovo 2/3 od svih zaposlenih radnika u metalnoj i elektroindustriji. Slijedom našeg dugogodišnjeg iskustva u pregovorima s brojnim poslodavcima mišljenja smo da ne radite dobro ni kao poslovni čovjek – menadžer ni kao čovjek jer ste isključivo profitu podredili odnos s radnicima. Uvjeravamo vas da jedino zadovoljan radnik može i želi za svoju normalnu plaću i u uređenoj radnoj sredini raditi i za povećanje profita poslodavca, odnosno vlasnika. Vašim odnosom prema socijalnom partneru-sindikatu i radnicima to neće biti slučaj, budući da ćete kršenjem prava radnika iz rada i temeljem rada postići upravo suprotan efekt od vašeg temeljnog motiva-rasta profita. Stoga Vas još jednom pozivamo da sindikate u Australiji kao i članove, a ujedno i radnike prihvatite socijalnim partnerima.
Sindikat metalaca Hrvatske će informaciju o vašem ponašanju prema radnicima učiniti dostupnom hrvatskoj javnosti bez obzira na struku i poslove kojim se pojedini radnici ili tvrtke bave, a to znači da će ova informacija biti dostupna i budućim kupcima vaših proizvoda. Na kraju sa žaljenjem konstatiramo da proizvodite proizvode-slušne aparate o kojima pojedinim ljudima ovisi egzistencija, a da se u toj vašoj tvrtki krše sindikalna i ljudska prava.
Uvjereni smo za dobrobit obiju socijalnih partnera da ćete svoje odluke povući i sindikate prihvatiti pravim partnerima.

Dear Mr. Roberts,
The information on the violation of human and trade union rights reached the Metalworkers’ Trade Union of Croatia (SMH) too, which in Croatia organizes almost 2/3 of all the employed in metal and electro industry.
Following our long and rich experience in negotiations with numerous employers, we are of the opinion that you are not working well neither as a businessman, manager nor as a human being because profit only is far more important for you than your workers.
We assure you that only satisfied worker can and wants to work for his/her salary and in settled working environment for the increase of employers’/owners’ profit. Your attitude and approach to a social partner – trade union and workers will not contribute to this, since by the violation of workers’ rights arising from work and based on work you will succeed only the opposite effect than your fundamental motive – profit increase. This is why we call upon you to accept trade unions in Australia and their members, and workers too, as your social partners.
Metalworkers’ Trade Union of Croatia will make public the information on your behaviour towards workers, regardless of the profession and jobs of individual workers and company, which means that this information will be accessible to the future buyers of your products.
Finally, it is with regret that we have to state that your company produces hearing devices on which subsistence of some people depends, and that your company breaches trade union and human rights.
We are convinced, for the good of both social partners that you will withdraw your decisions and accept trade unions as your real partners.
